1. Introduction and Acceptance of Terms
These Terms & Conditions ("Terms") govern your use of the https://www.redchillies.be website ("Website") and any orders you place through it. By accessing the Website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree with any part of these Terms, you should not use the Website or place orders through it.
These Terms do not affect your mandatory statutory rights under Belgian and European Union consumer protection law, which cannot be excluded or limited by contract.

3. Eligibility to Place Orders
To place an order through the Website, you must:
- Be at least 18 years of age, or have the consent of a parent or legal guardian;
- Be able to collect your order from the restaurant;
- Be authorised to use the payment method provided.
Orders for alcoholic beverages, where available, may only be placed by persons who have reached the legal minimum drinking age in Belgium. We reserve the right to refuse service of alcoholic beverages if we have reasonable grounds to believe the customer does not meet the age requirement.
4. Website Usage
You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of any third party or restrict anyone else's use of the Website. You must not misuse the Website by knowingly introducing viruses, trojans, or other harmful material, or by attempting to gain unauthorised access to the Website or its underlying systems.
5. Menu, Product Descriptions and Allergens
We make every reasonable effort to ensure that the descriptions, images, and ingredient information shown on the Website are accurate and up to date. However, minor variations may occur between the images displayed and the food served, due to the nature of freshly prepared dishes.
5.1 Food Allergens
Our food may contain or come into contact with common allergens, including but not limited to nuts, gluten, dairy, eggs, soy, shellfish, and sesame. Allergen information is provided where reasonably possible, but because our food is prepared in a shared kitchen environment, we cannot guarantee that any item is completely free from allergens.
It is the customer's responsibility to inform us of any food allergies or dietary requirements when placing an order. If you have a serious or life-threatening allergy, we strongly recommend that you contact us directly before ordering so that we can advise you appropriately.
6. Prices and VAT
All prices shown on the Website are in euros (EUR) and include applicable Belgian VAT. We reserve the right to change prices at any time without prior notice. However, any price changes will not affect orders that have already been confirmed and accepted by us.
7. Availability of Products
All menu items are subject to availability. If a product you have ordered is not available, we will contact you as soon as reasonably possible to inform you. In such cases, we may offer a suitable alternative or a refund for the unavailable item. You are under no obligation to accept a substitute.
8. Order Placement and Acceptance
8.1 Placing an Order
When you place an order through the Website, you are making an offer to purchase food from us. Your order is not accepted until we send you an order confirmation. An automated order acknowledgement does not constitute acceptance.
8.2 Order Confirmation
We will send you an order confirmation once we have accepted your order. A binding contract between you and us is formed at the point when your order is confirmed by us.
8.3 Right to Refuse or Cancel an Order
We reserve the right to refuse or cancel any order at our reasonable discretion, including but not limited to the following circumstances:
- An item is no longer available;
- A pricing or product description error has occurred;
- We are unable to fulfil the order due to technical, operational, or other reasons;
- We suspect the order is fraudulent or made with an unauthorised payment method.
If we cancel an order for which payment has already been taken, you will receive a full refund.
9. Payment Terms
9.1 Payment Methods
We accept payment by debit card, credit card, and other payment methods as indicated on the Website at the time of checkout. All payments are processed securely through our payment service provider.
9.2 Payment Authorisation
By providing your payment details, you confirm that you are authorised to use the payment method and that the information you have provided is accurate. Your payment will be authorised at the time of order placement.
9.3 Failed Payments
If your payment cannot be processed or is declined, your order will not be accepted. We are not responsible for any charges your bank or payment provider may impose in connection with a failed or declined transaction.
9.4 Payment Security
We do not store your full card details on our servers. All payment transactions are handled by our payment service provider in accordance with applicable security standards. Please refer to our Privacy Policy for further details on how payment-related data is processed.
10. Pickup and Takeaway Orders
All orders placed through the Website are for pickup/takeaway from our restaurant. We do not currently offer a delivery service.
- You will receive an estimated pickup time in your order confirmation.
- Please collect your order within a reasonable time of the estimated pickup time. Food left uncollected for a prolonged period may be disposed of and no refund will be given in that case.
- We may ask you to confirm your identity or provide your order number upon collection.

11. Customer Responsibilities
11.1 Contact Information
You are responsible for providing a valid telephone number and email address when placing your order so that we can contact you if needed regarding your order.
11.2 Timely Collection
You must collect your order from the restaurant within a reasonable time of the estimated pickup time. If you are unable to collect your order, please contact us as soon as possible.
11.3 Food Safety After Collection
Once your order has been collected by you, you are responsible for storing and consuming the food safely and within a reasonable timeframe. We are not liable for any issues arising from improper storage or delayed consumption after collection.
12. Cancellation
Because our food is prepared specifically for each customer order and is generally perishable, the EU right of withdrawal that applies to many online purchases does not apply to orders for perishable food or food prepared to the customer's specification, in accordance with Article VI.53, 4° and 5° of the Belgian Code of Economic Law.
However, cancellation requests made within 5 minutes of placing the order, and before food preparation has started, will normally be accepted and a full refund will be issued. For full details, please refer to our Cancellation Policy.
Your mandatory statutory rights remain unaffected.
13. Refunds
Refunds may be available in certain circumstances, including where an order is incorrect, incomplete, significantly differs from its description, or has a legitimate quality issue. Full details are set out in our Refund Policy.
Your mandatory statutory rights under Belgian and EU consumer law are not affected by these Terms.
14. Complaints
14.1 How to Complain
If you have a complaint about your order, please contact us as soon as possible using the details below. To help us resolve your complaint quickly, please provide:
- Your order number;
- A description of the problem;
- Photographs, where applicable (for example, if items are missing, incorrect, or damaged).
14.2 Incorrect or Missing Items
If your order contains incorrect or missing items, please notify us promptly. We will, at our discretion, either provide a replacement, offer a credit, or issue a refund for the affected items.
14.3 Damaged Orders
If your order is damaged at the time of collection, please notify us immediately before leaving the restaurant. We may ask for photographic evidence. Depending on the circumstances, we may offer a replacement, partial refund, or full refund for the damaged items.
15. Website Availability
We endeavour to ensure the Website is available at all times, but we do not guarantee uninterrupted access. The Website may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our reasonable control. We are not liable for any loss resulting from temporary unavailability of the Website.
16. Intellectual Property
All content on the Website, including text, images, logos, graphics, and design elements, is the property of SONID SRL (trading as Red Chillies) or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from the Website without our prior written consent.
17. Limitation of Liability
To the fullest extent permitted by applicable Belgian and EU law:
- Our total liability to you in respect of any order shall not exceed the total amount paid by you for that order.
- We shall not be liable for any indirect, incidental, or consequential loss or damage arising from or in connection with your use of the Website or any order placed through it.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Belgian or EU law. Your mandatory statutory consumer rights remain unaffected.
18. Force Majeure
We are not liable for any failure to perform, or delay in performing, our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, power failures, internet outages, government actions, or disruptions to supply chains.
19. Changes to These Terms
We may update these Terms from time to time. The updated version will be published on this page with a revised "last updated" date. Changes will not apply retroactively to orders already placed and confirmed. By continuing to use the Website after changes are published, you accept the updated Terms.
20. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from or in connection with these Terms shall be subject to the jurisdiction of the competent Belgian courts.
As a consumer resident in the European Union, you also have the right to bring proceedings in the courts of your country of residence, and you benefit from any mandatory consumer protection provisions of your local law that cannot be waived by agreement.

In accordance with EU Regulation No 524/2013, you may use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes relating to online purchases. The ODR platform is available at:
